Abstract

The medical record is an essential document in health care, since it systematically documents data on the care processes of each patient; it also includes ethical and legal implications linked to data ownership, custody and access. This study therefore aims to determine and examine the strategies for legal and ethical safeguarding of medical records in the practice of medicine, with a particular focus on their management during the hospital stay. The research adopted a qualitative-quantitative, non-experimental, descriptive and documentary method, with the study of scientific publications and current regulations related to the safeguarding and privacy of medical records, based on a systematic analysis of the literature, using the PRISMA method. Three fundamental elements of medical record regulations were recognised: ownership, custody and access. These components are essential in decision-making in the hospital environment and may cause doubts in nursing professionals about their correct management. The nursing team has resources to protect the medical record, ensure patient privacy and comply with regulations. Improved staff training and new strategies to protect medical information are recommended.
